Warsop woman fined after scrap man fly-tipped her rubbish

A Warsop woman pleaded guilty to an offence connected to a fly-tipping incident after she used a scrap man to dispose of rubbish for her.

Joanne Dunkley, 43, of Sherwood Street, Warsop, admitted one charge of failing in her duty of care contrary to contrary to s34(2A) and (6) of the Environmental Protection Act 1990.

At Mansfield Magistrates’ Court on Tuesday December 15, she was sentenced to a two-year conditional discharge and ordered to pay a £15 victim surcharge and £285 legal costs and £145 Community Safety costs.

Waste was found in Oakfield Lane on February 2015 and on the service road between B6035 Forest road and A6075 Peafield Lane, in Mansfield on 12 February 2015.

The court heard she had disposed of household waste through a scrap man collecting on the street and failed in her household duty of care by not checking for a waste carrier’s licence.

Councillor Mick Barton, Portfolio Holder for Public Protection at Mansfield District Council, said after the case: “People who use a scrap man on the street to get rid of their waste can be doing so at their own peril if that waste is later fly-tipped. “People must ensure they use only licensed waste carriers to dispose of waste. Protect yourself from this kind of prosecution by always getting a receipt and verified contact details of the person removing their waste.”
