Three are fined after waste lands them down in the dumps

The three had dumped everything from household waste to old carpet and bags of cement.

Joel Marshall (41), of Kirkby, pleaded guilty to transporting controlled waste without being a registered carrier.

He was also found guilty during a Nottingham Magistrates Court trial last month of failing to take all reasonable measures to prevent another person from fly tipping.

At the trial on 20th August the court was told how Marshall had arranged to dispose of three skip bags containing mixed household waste, some carpet and a red plastic container for a private householder.

But the waste was found on an industrial unit on Hamilton Road, Sutton. It emerged during the hearing that Marshall had shown the householder a waste carrier’s licence belonging to someone else.

Magistrates imposed total fines and costs of £763 and a 12-month conditional discharge.

Lisa Birkin (39) of Mansfield, admitted failing to ensure a waste carrier was authorised when 25 bags of mixed domestic waste were found dumped at a private property and traced to her.

She had paid an unregistered carrier £30 to deal with the waste.

She was given fines and costs of £377.32.

Ashley Scott (23), of Sutton, admitted failing to prevent another person from fly tipping and knowingly causing controlled waste to be deposited from a vehicle.

It emerged during the hearing that two men were seen at the rear of a white van registered to Scott offloading garden waste, polystyrene and plastic at a Kirkby business.

Scott was unable to provide an explanation of how his business waste had been fly tipped or of any measures which he had taken to ensure that the waste was not fly tipped.

When interviewed by council officers, Ashley Scott denied fly tipping and denied he had ever been to the location of the fly tip.

The Court imposed a total of £750 in fines and costs.
