Lindhurst Development back in court

The Lindhurst development, between Southwell Road West and Nottingham Road, was granted planning permission by Mansfield District Council.

But campaigners believe the environmental impact of the scheme will kill off local wildlife and the green views once enjoyed from their homes will be lost.

The Royal Courts of Justice granted an application for judicial review at a hearing in London yesterday and it will now be heard before Christmas.

The Lindhurst Group wants to develop the 417 acre-site, which would include up to 1,700 new homes, but the plan has led to an drawn-out legal row.

Earlier this year, the Administrative Court rejected plans for a judicial review.

Campaigner Shlomo Dowen said: “This is brilliant news and great for the people of Mansfield. This could all have been avoided if Mansfield District Council had handled it properly.”

Stephen Garner, environmental campaigner and county councillor for Mansfield South, added: “I would like to thank the people of Mansfield for their support so far.

“Residents are fed up with developments taking away our countryside.

“We have an array of brown-field sites in Mansfield and we should be saving our countryside for our children and grandchildren.”

Mansfield Mayor Tony Egginton said: “The courts have already dismissed three applications for permission to appeal against the planning application and on all occasions the judges felt that there was no arguable case for a judicial review. “We are disappointed by this latest decision but the council will continue to robustly defend its original decision.”
