Italo Stradins, 48, of Pleasley Springs, Pleasley, admitted being in charge of a motor vehicle while over the legal alcohol limit at 9.30pm on June 2 on Kings Mill Lane.

Officers heard Stradins turn the engine of his Citreon Picasso on and try to reverse, but the car did not move as the handbrake was on.

Morgan Hogarth, mitigating, explained that Stradins had gone fishing at the reservoir with a friend and had been drinking, but when they saw signs prohibiting night fishing and checked their license, realised they were in the wrong.

Stradins called his daughter to collect them, but she was unable to come, said Mr Hogarth. When he saw the blue flashing lights of a police car, he tried to move his vehicle.

A breath test revealed he had 61 microgrammes of alcohol in 100 millilitres of breath when the legal limit is 35 microgrammes.

He was fined £180 and ordered to pay costs of £85 and a victim surcharge of £30.

Magistrates used their discretion not to disqualify Stradins and instead put ten points on his driving licence.
