Sutton man assaulted partner in breakfast row and smashed up his own property

A Sutton man who assaulted his partner in a row at the breakfast table also hurled garden furniture around and smashed his own property, a court has heard.

Kieran O'Donnell grabbed his partner's arm, leaving fingerprint bruises and a scratch, during arguments early in the morning of August 25 last year, said Jill McIlroy, prosecuting.

As she was pouring milk on her son's cereal, O’Donnell swiped the bowl aside and spilled the contents all over her.

When she reached for her phone to call police he grabbed and smashed it before smashing his own phone when she reached for that.

And when his partner ran to a neighbour's house to dial 999 he threw garden furniture around before dragging her back inside and breaking the door handle as he slammed it shut.

“Given this was a young mother in a vulnerable position this was a domestic abuse incident,” said Ms McIlroy.

The court heard he has previous convictions for motoring offences.

Charnelle Turner, mitigating, said O’Donnell’s partner did not support the prosecution and they had resumed their relationship.

"He says he would never hit her but there was back and forth,” she said. “There was pushing and shoving.”

She said the self-employed road-mender is struggling financially and there have been no incidents since.

O'Donnell, aged 35, of Springwell Street, Huthwaite, admitted battery and criminal damage, when he appeared at Nottingham Magistrates Court, on Wednesday.

District judge Gillian Young told him: “This occurred in her home, a place where she should be able to feel safe.”

He was fined £690 and ordered to pay a £276 surcharge and £85 costs.
