Kirkby man who sat in his car while drunk shown mercy by magistrates

Mansfield magistrates showed mercy on a Kirkby man who was caught by police sat in his car while more than two times over the drink-drive limit.

The town’s court were told how Jason Burgess (27), of Nuncargate Road, had been at a friend’s house on Southwell Crescent and went out to his car for a cigarette.

Robert Car, prosecuting, said: “Mr Burgess said he did not realise he had been over the limit but accepts he was in charge of the car.”

His defending solicitor said: “There is no record of him attempting to drive off.”

He said Burgess was a carer for his parents and would lose his job if he was banned.

Instead his licence was endorsed with ten points, He was also fined £80 and ordered to pay a victim surcharge of £20.
