Ashfield residents fined for failing to clear rubbish

Two Ashfield residents have been convicted for failing to clear waste from their gardens.

Both Mark Robinson, of Park Road, Kirkby, and Zoe Jacques, of Common Road, Huthwaite, were given multiple warnings and subsequently issued with Community Protection Notices (CPN), following complaints from neighbours about rubbish dumped in their gardens.

Jacques’ neighbours also complained that her dumped rubbish attracted rats to the area.

Despite these warnings, neither Robison or Jacques removed or disposed of the waste in their gardens.

After continuing to breach their CPN’s, both were issued with Fixed Penalty Notices (FPN).

When neither FPN was paid, and rubbish remained in both gardens, Ashfield District Council’s community safety team took prompt action in both cases and applied to take both cases to court.

Both were summoned to appear at Mansfield Magistrates Court on January 29, but both failed to attend.

In their absences it was proved that both had breached their CPNs.

Robinson fined £220 for failing to comply with the CPN, plus a victim surcharge of £32 and costs of £507.52, making a total fine of £759.52.

Jacques was fined £200 for failing to comply with the CPN and ordered to pay a victim surcharge of £32 and costs of £582.44, making a total fine of £814.44.

Coun Helen-Ann Smith, cabinet member for community safety, said: This should act as a warning to all those that think it is okay to dump waste in

their gardens and get away with it.

"The council in committed to dealing with anti-social behaviour and those that think they can get away with it.”
