Bike thief injured in crash

David Peter Moran, 31, of Courtleet Way, admitted stealing the Yamaha motorbike on December 29, 2015, from outside the Stadium Leisure Centre on Nottingham Road in Basford.

The court heard that Moran damaged three cars before he ended up covered in blood, and lying ‘under a vehicle’ with ‘severe’ head and leg injuries.

Marjorie Kirkham-Smith, prosecuting, said: “The aggravating feature was that he was on bail to crown court for two counts of attempted vehicle theft, going equipped to steal and four counts of vehicle theft.”

The court heard that Moran, who is currently in custody at Nottingham prison, had been banned from Nottingham city centre as a condition of his bail.

Chris Saunders, mitigating, argued that the crown court matters should be dealt with separately.

He said: “Mr Moran is innocent until proven guilty. If we ever forget that it will be a very said day.

“Initially he entered a not guilty plea to the first of the charges.

“Mr Moran’s memory has been severely impaired by the accident that ensued. He was lying under a motor vehicle.

“The ambulance were the first on the scene to get him out from under the car.

“He had severe head and leg injuries. There was a lot of blood. His initial plea was corrected seven days later.”

He said it took police ‘a period of time’ to get his name from him and to work out if he was British or not, ‘such was the confusion’ at the scene of the accident.

The court heard that Moran hoped to resume contact with his three children.

He was sentenced to 12 weeks in prison for aggravated vehicle taking and 12 weeks for driving while disqualified, to run concurrently.

He was also banned from driving for 12 months and three weeks.

Magistrate David Allen said a custodial sentence had been imposed because of Moran’s previous record, his inability to comply with court orders, the fact that the crime was committed while he was on bail and the high risk of his re-offending.
