Ban for man caught drink driving for third time

A Mansfield man who was caught drink driving in a company van while disqualified has been sacked and banned for five years.

David Lee Carnall, 37, of Lord Street, admitted drink driving without insurance or a license at Mansfield Magistrates’ Court on March 24.

A breath test revealed he was nearly twice over the legal limit.

The court heard Carnall received a three year ban in 2014 and had a previous conviction for drink driving from 2009.

Andrew Osborne, mitigating, said: “He has had alcohol problems for some time which his partner was trying to get him to address.”

He said Carnall suffered from depression and poor health.

He explained Carnall had been working as the branch manager of a tool hire firm in Nottingham and had gone for a drink after work with colleagues.

Carnall took the keys for the company’s Peugeot van and decided to drive home.

Someone reported him to police and he was stopped at 11pm on March 24, near the Rushley pub on Nottingham Road in Mansfield.

Carnell was subsequently fired, said Mr Osbourne.

Deputy District Judge Derek French said: “You had two previous drink driving matters, the readings were twice the legal limit and when you drove on this occasion you had no license or insurance.

“If you add all this together you were an accident waiting to happen. You have come very close to a custodial sentence.”

Carnall was given a 16 week sentence, suspended for 12 months, and ordered to go on a six-month alcohol treatment course, with a 12-day rehabilitation activity requirement.

He was disqualified for five years and ordered to pay costs of £85 and a victim surcharge of £80.
