A JAIL sentence hangs over a drunken Shirebrook man who attacked a police officer called to a midnight disturbance outside a bar.
Police saw 20 men and women had gathered outside the Great Northern pub where Lee Spizer (24) was behaving aggressively towards a bouncer.
He told officers to get out of his way, saying he wanted to fetch his jacket from the bar - but door staff said he had not been wearing a jacket.
Chesterfield magistrates was told on Wednesday that Spizer was warned to stop swearing and advised to go home and come back the following day.
He then put his face up against Pc Gareth Stray, puffed out his chest and took up a fighting stance.
Said prosecutor Becky Mahon: "The officer pushed him back to create more space between them and the defendant punched out at his chest.
"He was arrested and he responded with abuse and kicked Pc Stray on the shin."
Spizer was restrained by another officer, whose radio was torn from his shirt, and he lashed out as he was taken to the ground.
"He pivoted around Pc Stray and punched him in the right eye," said Miss Mahon, adding that Spizer was handcuffed and then sprayed with CS gas to subdue him.
He headbutted a rear window of a police car several times after being placed inside the vehicle. Spizer later told police he could not recall his actions because he was drunk.
Spizer, of Hill Crest, Shirebrook, admitted assault on police and using threatening behaviour on 1st September.
He had previous convictions for assault and damage.
The bench imposed a four-month prison sentence but suspended it for a year and ordered him to pay £150 compensation to Pc Stray, with £60 costs.
He also received an 18-month probation supervision order to include anger management counselling.
In mitigation, Steve Williams said: "He regrets his actions which were entirely due to the amount he had had to drink. It seems he reacted badly to the presence of police and lost control for a brief period."
