Sutton man found wandering in boxer shorts

A Sutton man who was found wandering around, dressed only in his boxer shorts, on a cold and wet February night told police he was fine and tried to run off, a court heard.

Officers found Damien Swain on Sheepbridge Lane, Mansfield, just after midnight, on February 1, dressed only in shorts and trainers.

Police saw he was reluctant to answer questions and agitated and unable to stand still,” said Robert Carr, prosecuting.

“It was raining and cold so they asked him to get into the police car.

“He shouted: “It’s fine, I will walk!” and ran off.”

When an officer tried to stop him, Swain “took up a fighting stance” and said: “Don’t f****** come near me.”

The officers tried to take hold of his arms and he struggled. They struck him in the chest and handcuffed him.

Swain, 20, of Percival Crescent, admitted disorderly behaviour when he appeared before magistrates in Mansfield, on Thursday.

He told the court: “It will never happen again.”

He was given a six-month conditional discharge, with £85 costs and a £20 victim surcharge.
