Boozy biker was '˜only moving his bike' in Mansfield

James Wilson, 40, of Foxglove Grove, Mansfield Woodhouse, admitted failing to provide a specimen when he appeared before magistrates in Mansfield.

Ruth Snodin, prosecuting, said a police officer spotted Wilson riding a motorbike with no lights on Leeming Street, on the night of July 24, and suspected he was drunk because he appeared to be wobbling from side to side.

Ms Snodin said the officer stopped him outside the Widow Frost pub where Wilson asked: “What’s it got to do with you?”

When the officer confiscated his keys, she said Wilson told him: “I ain’t telling you anything.”

Wilson was arrested for driving while over the limit but failed to provide a specimen for analysis.

The court heard he was subject to a suspended sentence for two counts of common assault which expires at the end of the month.

Chris Lacey, mitigating, said: “The facts of this case are quite unusual. He accepts committing the offence but doesn’t accept what happens in the lead up.”

Wilson claimed he went into town and had a drink but did not intend to ride his bike home.

“He said they didn’t see him riding it because he wasn’t riding it,” said Mr Lacey.

He said he rarely drank because of the terms of his suspended sentence and was studying to be an accountant.

The probation service said Wilson was working positively to tackle his problems with alcohol and anger management.

Magistrates extended his suspended sentence by four months during which time he must abide by a 7pm to 7am curfew.

He was banned from driving for three years. He was ordered to pay costs of £85 and a victim surcharge of £85.
