BOLSOVER dad Ross Layden (27), who breached a community sentence imposed for shoplifting offences, has been spared a return to jail.
“This is his third breach,” probation officer Katie Shannon told the Chesterfield bench last Wednesday.
She said he had failed to attend unpaid work sessons without explanation and had ignored enforcement letters sent by the probation service.
Layden, of Charlesworth Street, Carr Vale, admitted breaching the order. It was replaced by a 7pm-6am curfew for one month. Magistrates said they would have locked him up for the ‘persistent breaches’ but for a recent spell he had served in custody.
“He had relapsed into heroin use and that’s why he struggled to comply with the order,” said Chris Perry, for Layden.
He had managed to detoxify during a period in custody and was prescribed medication to help him stay off drugs.
